These Terms of Service ("Terms") govern your use of cleartoclosemortgage.net (the "Site") operated by Clear to Close Mortgage LLC ("Clear to Close Mortgage," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Informational Purpose Only
The content of this Site is provided for general informational purposes about residential mortgage lending. Nothing on this Site constitutes legal, financial, tax, or professional advice. Nothing on this Site is an offer to lend, a commitment to lend, or a guarantee of any loan terms. All mortgage applications are subject to underwriting approval, credit qualification, property appraisal, applicable program guidelines, and the policies of the sponsoring licensed mortgage company.
2. Eligibility
The Site is intended for use by individuals who are at least eighteen years of age and who reside in jurisdictions where the sponsoring licensed mortgage company and the licensed loan originator referenced on this Site are authorized to conduct business. Information presented on this Site does not constitute a solicitation of business in any state where the originator or sponsoring lender is not licensed.
3. Licensed Individuals and Sponsoring Lender
Loan origination activity related to inquiries received through this Site is conducted by licensed individuals operating under a state-licensed mortgage company. The licensed loan originator referenced on this Site is Frank Gonzales, NMLS #1650963, operating under Do Good Lending (NMLS to be displayed in the footer). Licensing status may be verified through the NMLS Consumer Access portal at nmlsconsumeraccess.org.
4. Acceptable Use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in any way that violates these Terms
- Attempt to gain unauthorized access to the Site, its servers, or any related systems
- Interfere with or disrupt the Site, its servers, or any networks connected to the Site
- Use any automated system, including robots, spiders, or scrapers, to access the Site in a manner that sends more request messages to our servers than a human can reasonably produce in the same period
- Submit false, misleading, or fraudulent information when contacting us
- Use the Site to transmit malware, viruses, or any other harmful code
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity

To the fullest extent permitted by law, in no event will Clear To Close Mortgage, its affiliates, sponsoring licensed lender, licensed individuals, officers, employees, agents, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or any other intangible loss arising out of or in connection with your use of, or inability to use, the Site, even if advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Clear To Close Mortgage, its affiliates, sponsoring licensed lender, licensed individuals, officers, employees, agents, and service providers from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of such courts.
13. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect.
14. No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative.
15. Changes to these Terms
We may update these Terms from time to time. The effective date at the top of this page will be updated when changes are made. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, stop using the Site.
